Who it's for
For right to manage (RTM) companies
We don't do the RTM claim itself
Our free guides explain the process on the current rules and link to the prescribed forms and LEASE. For help with the claim, use a specialist or a solicitor: we start where they finish.
Where you are
Your situation
- The freeholder still owns the building and the leases don't change.
- Your RTM company now manages: services, repairs, maintenance, insurance and the service charges that pay for them.
- Its directors are usually volunteer leaseholders, and every qualifying tenant is entitled to be a member.
What the job involves
What the law and the leases ask of you
Take over properly
Ask the old manager for the information and documents you need: they have 28 days to provide them. Collect any uncommitted service charges and register the contracts you're taking on.
Bill and account for service charges
Demands must carry the landlord's name and address and the summary of tenants' rights. Costs not billed or notified within 18 months can be lost.
Consult before major works
Works that would cost any one leaseholder more than £250 need Section 20 consultation first.
Keep the freeholder informed
Give the freeholder notice before approving things under the leases (30 days for major approvals), and report breaches within 3 months.
Keep the building safe and insured
Fire safety in the common parts, safety checks and the buildings insurance the leases call for.
Run the company
File the confirmation statement and accounts at Companies House, keep the registers and hold members' meetings.
